21. HOW DO I APPLY FOR A WORK PERMIT?In general, you must apply for a work permit before entering Canada. In some cases, the foreigner can present his request at the border. Due to COVID-19, we are temporarily allowing visitors to apply online for a work permit from within Canada.

22. WHAT IS AN OPEN WORK PERMIT?An open work permit is a work permit that is not tied to a particular job. Due to the fact that it is not related to a given job, it is not necessary to obtain the following documents to apply for a work permit: · a Labor Market Impact Assessment (LMIA) from Employment and Social Development Canada; · Proof that an employer has submitted an offer of employment through the Employer Portal and has paid the Employer Compliance Fee.< /p> In most cases, you will need to pay the open work permit holder fee at the same time as the work permit fee. 23. WHO CAN APPLY FOR AN OPEN WORK PERMIT?You may be eligible for an open work permit if: · You are an international student, have graduated from a Designated Learning Institution and are eligible for the Post-Graduation Work Permit Program. · You are a student and are no longer able to pay the costs of your studies (poor student). · You have a work permit linked to a specific employer and are the victim of violence or are at risk of violence in the course of your employment in Canada · You have applied for permanent residence in Canada. · You are a dependent family member of a person who has applied for permanent residence. · You are the spouse or common-law partner of a skilled worker or an international student. · You are the spouse or common-law partner of a participant in the Atlantic Immigration Pilot Program. · You are a refugee, asylum seeker, protected person or a member of their family. · You are subject to a removal order that cannot be enforced. · You are a holder of a temporary residence permit. · You are a young worker participating in special programs. In each of these situations, you must meet additional criteria to qualify.

24. WHAT IS A LABOR MARKET IMPACT ASSESSMENT?A Labor Market Impact Assessment (LMIA) is a document that a Canadian employer may need to obtain before hiring a foreign worker. A positive LMIA indicates that you need to hire a foreign worker to do the job. It also indicates that no Canadian worker or permanent resident is available to do so. A favorable LMIA is sometimes called a confirmation letter. If the employer needs an LMIA, they must apply for one. Once the employer receives the LMIA, the worker can apply for a work permit. To apply for a work permit, a worker must have: · a job offer letter; · a contract; · a copy of the LMIA; · the LMIA number.

26. WHO ARE THE FEDERAL SKILLED WORKERS?Skilled workers are selected as permanent residents based on their education, work experience, knowledge of French or English, and other factors. These are aspects that often help them succeed in Canada. As of January 1, 2015, anyone wishing to immigrate to Canada permanently as a skilled worker under the following three federal programs: the Federal Skilled Worker Program the Federal Skilled Trades Program Canadian Experience Class, must first create a profile in the Express Entry system. Skilled workers who wish to settle in Quebec apply under a separate category. Quebec selects its own skilled workers. Thus, applicants who wish to settle in Quebec are called "skilled workers selected by Quebec".

27. DO I NEED TO INCLUDE PROOF OF FUNDS WITH MY EXPRESS ENTRY APPLICATION?You will have to indicate, in your Express Entry profile, the amount of money you will have to settle in Canada. This information is intended to show that you will be able to support yourself and any family members accompanying you to Canada, and helps CIC determine which programs you may be eligible for. You will need to meet the establishment funds requirements only if such criteria apply to the program for which you receive an invitation to apply. If you receive an invitation to apply under the Federal Skilled Worker Program or the Federal Skilled Trades Program, you will need to demonstrate that you meet the settlement fund requirements. · As proof, you must obtain an official letter from any bank or other financial institution where your money is located. The letter(s) must include a list: all current bank and investment accounts: all outstanding debts, such as credit card balances and loans.

10. DO I NEED A PERMIT TO STUDY IN CANADA?Most foreigners need a permit to study in Canada. Some people in particular situations may not need it. You should apply for a study permit before coming to Canada. Before applying, you must have a letter of acceptance from a designated learning institution in Canada. Your study permit is not a travel document. Your permit allows you to study in Canada, but you may also need a visitor visa (temporary resident visa) or an Electronic Travel Authorization (eTA) to enter Canada. If we approve your study permit, we will also give you a visitor visa or an eTA, depending on your case. This document will allow you to enter Canada.

11. I AM AN INTERNATIONAL STUDENT IN CANADA. CAN I WORK DURING MY STUDIES?You may be able to work in Canada while you study if your study permit has a condition that says you can work on or off campus. You must also meet all other requirements. You can only start working in Canada after you have started your study program. You cannot work before you start your studies.

12. WORKING ON CAMPUS OR OFF CAMPUSAs a study permit holder, you may be able to work on or off campus without having to obtain a work permit. Make sure you meet the requirements before you find a job.

13. WORK AS A PARTICIPANT IN A CO-OPERATIVE PROGRAM OR AS AN INTERNYou will need to obtain a work permit if your study program includes a co-op placement or a mandatory internship. Find out how to apply for a co-op work permit.

14. WORKING AFTER YOU GRADUATEYou may also be able to apply for a Post-Graduation Work Permit (PGWP) so you can continue to work in Canada after you graduate. Find out if you qualify for a PGWP.

15. WHEN SHOULD I APPLY FOR A STUDY PERMIT?Apply for your permit as soon as you receive your acceptance letter. The time required to process an application may vary from one visa office to another.

16. I AM AN INTERNATIONAL STUDENT. CAN I RETURN TO MY COUNTRY OR TRAVEL OUTSIDE OF CANADA DURING MY STUDIES?Yes. However, remember that a study permit is not a travel document. It does not give you the right to come to or enter Canada. In addition to your permit, you may need: a visitor visa (temporary resident visa) or an electronic travel authorization (eTA).

17. I WANT TO CHANGE SCHOOL OR PROGRAM OF STUDY. HOW CAN I CHANGE MY STUDY PERMIT?you do not need to change your study permit if you change schools or programs of study. · If you are studying in secondary school If you are moving to a post-secondary institution and want to be able to work while you study, you must apply to change the conditions of your study permit. There are fees associated with this change. To do this, you must reapply for a study permit from within Canada. · If you are studying at a post-secondary institution While you don't have to change your study permit, you still need to let us know when you change your post-secondary institution. Find out how to let us know you've changed post-secondary institutions. · If you begin to attend an educational institution in Quebec If you are going to attend an educational institution in Quebec (and the previous school you attended was outside Quebec), you must obtain a Quebec Acceptance Certificate (CAQ). You need a CAQ for schools at any level, including primary schools. While you don't have to change your study permit, you still need to let us know when you change your post-secondary institution. 18. CAN YOU APPLY FOR A STUDY PERMIT AT PORT OF ENTRY?In general, you should not apply for a study permit at a port of entry into Canada. You must apply for a study permit online before traveling to Canada. Only certain people can apply at the port of entry at this time. You can apply at the port of entry if you are: a US citizen; a lawful permanent resident of the United States; a resident of Greenland; a resident of Saint-Pierre-et-Miquelon. If you meet any of these requirements, you must have all the required documents on hand to apply for a study permit when you arrive at the border. The border services officer who will meet you will determine if you can enter Canada as a student.

19. IF YOUR STUDY PERMIT EXPIRES SOON BUT YOU WISH TO STAY LONGER; WHAT TO DO?· If you are a student, you have 3 options: a) You can extend your study permit if you wish to continue your studies. b) You may be able to apply for a Post-Graduation Work Permit (PGWP) or Work Permit, if you have completed your study program. c) You can request to change your status to visitor status You must apply for one of these options before your study permit expires or you may have to leave Canada. · If your study permit has expired If your study permit expires before you apply for an extension, you have lost your status as a student in Canada. You may be able to restore your status. · If you are a visitor who needs a study permit You can apply for a study permit online if you are already in Canada as a visitor. When you submit your application, you must follow the instructions for applying from abroad. We will process your request in the same time frame as if you had made your request from your home country, outside of Canada. You cannot start studying until you receive your study permit.

20. IF YOU WANT TO STUDY IN QUEBEC?If you want to study in Quebec for more than 6 months, you must apply for a Quebec Acceptance Certificate (CAQ). When applying for a study permit to study in Quebec, you will need to show us that your CAQ application has been approved. To do so, you can submit one of the following documents: · your official CAQ document (preferred option); · your letter of approval from the Ministry of Immigration, Francisation and Integration confirming that you will receive a CAQ. After December 31, 2021, you can only present one of the above 2 documents as proof to show that you will obtain a CAQ. No other type of proof will be accepted. If you get an official CAQ after submitting your study permit application, you can submit your CAQ using your online account or our web form. If you intend to study in Quebec for less than 6 months, you can apply for a study permit without needing a CAQ.

2. WHAT IS A CUI?UCI stands for Unique Client Identifier. It is also called “customer identifier”. This number appears on the official documents you receive from us. The client identifier takes one of two forms: · four digits followed by a hyphen and four more digits (example: 0000-0000). 3. WHAT IS MY UNIQUE CUSTOMER IDENTIFIER?Your unique customer identifier (also called UCI or customer identifier) is listed on all documents you receive from us. This is an eight or ten digit number that looks like this: 0000-0000 or 00-0000-0000.

7. WHERE TO PROVIDE BIOMETRIC DATA?At a VAC. Visa Application Centers (VACs) are private companies that accept applications and ensure that they are forwarded to the correct visa office. They will take your fingerprints and your photo (biometric data).

IF MY APPLICATION FOR A VISA, WORK PERMIT OR STUDY PERMIT IS REFUSED, WILL I HAVE TO PROVIDE MY BIOMETRIC DATA ON MY NEXT APPLICATION?No. When you apply for a visitor visa, work permit or study permit and provide your biometric data, it remains valid for 10 years, even if your visa or permit application is refused or your visa or permit has expired.

9. WHAT IS AN APPLICATION NUMBER?An application number is different from a unique customer identifier (UCI) or a customer identifier. You will have the same CUI or client identifier, but different request numbers.

28. HOW CAN I FIND MY NATIONAL OCCUPATIONAL CLASSIFICATION (NOC) CODE?Your National Occupational Classification (NOC) code is the number under which the occupation is listed in Canada's official occupational classification system.

29. CAN I COUNT ON STUDENT WORK EXPERIENCE TO MEET THE WORK EXPERIENCE REQUIREMENT IN THE EXPRESS ENTRY FRAMEWORK?It depends on where you worked and studied. To qualify for Express Entry, you must meet the minimum requirements for 1 or more Express Entry programs. This includes the work experience requirement. · Consider student work experience to meet minimum requirements Federal Skilled Worker Program Student work experience gained while studying in Canada or abroad counts towards meeting the minimum requirements of the Federal Skilled Worker Program if the following conditions are met : the work was remunerated by salary or commission; the work was continuous (no discontinuity in employment); the work has met all other Program requirements. This includes work-study sessions and internships. · Canadian Experience Class and Skilled Trades Program (Federal) Student work experience is not counted towards meeting the minimum requirements for the Canadian Experience Class or the Federal Skilled Trades Program.

30. DO I NEED TO TAKE A LANGUAGE ASSESSMENT TEST TO IMMIGRATE IN CANADA?To meet the eligibility criteria for one of the skilled worker programs covered by Express Entry, namely: the Federal Skilled Worker Program Canadian Experience Class, the Federal Skilled Trades Program You must provide, when you create your Express Entry profile, all the information relating to the language proficiency test you took for your first official language and, if applicable, your second official language .

31. WHAT IS CRIMINAL TERRITORIAL TERMINATION?This is the term used to describe a person who is not allowed to visit or remain in Canada because they have committed or been convicted of an offense abroad or in Canada .

32. WHAT DOES IT MEAN TO BE BANNED FROM TERRITORY ON HEALTH GROUNDS DUE TO EXCESSIVE BURDEN?This means that you will not be allowed to enter or remain in Canada, because your medical condition is likely to place an excessive burden on health or social services. This can mean that: · the need for health services to treat your medical condition could negatively affect wait times for medical services in Canada; · services to treat and manage your condition would likely cost more than three times the Canadian average for health and social services (per person).

33. CAN I ENTER CANADA IF I AM BANNED FROM TERRITORY?As a general rule, you cannot enter or stay in Canada if you are inadmissible. However, there are ways to lift the inadmissibility. You may be eligible to return to Canada if: · you can demonstrate to an immigration or border services officer that you meet the conditions to be presumed rehabilitated; · you apply for individual rehabilitation and get approval; or · you get a pardon or record suspension. You can also get a temporary residence permit if: you have reasons considered justified to enter or stay in Canada; and · you do not pose a risk because of your inadmissibility.

34. I WANT TO WORK IN CANADA AS A CAREGIVER/FAMILY BUT I DO NOT MEET THE REQUIREMENTS FOR THE PILOT PROGRAMS. WHAT OPTIONS ARE AVAILABLE TO ME?If you do not meet the requirements for the Home Child Care Provider Pilot Program or the Home Caregiver Pilot Program, you may be able to work temporarily as a caregiver under the Home Caregiver Program. temporary foreign workers if any of the following apply to you: · You are already in Canada and you are eligible to apply for a work permit from within Canada; · You are outside of Canada and your employer submitted an LMIA application to hire you before June 18, 2019; · You will work in Quebec. Your employer must first obtain a favorable LMIA.

35. I TRAVEL WITH MY MINOR CHILD WITHOUT MY SPOUSE. WHAT DOCUMENTS DO I NEED TO PRESENT?You must present the following documents: · a copy of the child's birth certificate; · a letter of authorization, preferably in English or French, signed by the parent who is not traveling with the child. The letter of authorization must indicate the address and telephone number of the parent who is not accompanying the child; · a photocopy of the passport or national identity card of the parent who is not accompanying the child, bearing the signature of the holder. If the parents are separated or divorced and they share custody of the child, the parent traveling with the child should carry a copy of the custody order. If the parents are separated or divorced and one parent has sole custody of the child, the release letter may bear only that parent's signature, and a copy of the court order. guard must be attached. If one of the child's parents is deceased, a copy of the death certificate must be attached.

36. 25. HOW CAN I HELP A RELATIVE OR FRIEND APPLY TO VISIT CANADA?If a friend or family member wishes to visit Canada, they must apply outside the country. Your friend or relative must submit their application to the Canadian visa office responsible for their country or region. A visa officer will review the application and decide whether to issue the visa. You can help your friend or family member by writing a letter of invitation that explains how you will help them. For example, you can offer to pay for plane tickets or accommodation. An invitation letter can be useful, but it does not guarantee that the person will obtain a visa.
